Terms of Use
The agreement between you and OpenMap. Please read the key points, then the full terms.
The short version
- OpenMap is a technology platform. Businesses and experts provide their own services, and your agreement is with them, not with us.
- The AI agent acts on your instructions. It stops for you at sign-in, payment and send, and you check and approve what it does.
- The agent can get things wrong, and nothing on OpenMap is legal, medical, financial or tax advice.
- You’re responsible for your account, your instructions and what you post.
- Our responsibility for loss is limited, but never for death or injury caused by our negligence, fraud, or your legal rights as a consumer.
- OpenMap isn’t an emergency service. In an emergency, call 999.
1. About these terms
These terms are the agreement between you and OpenMap.AI LTD (“OpenMap”, “we”, “us”), a company registered in England and Wales with company number 17493031, whose registered office is at Clubhouse Holborn, 20 St Andrew Street, London, EC4A 3AG, United Kingdom. They apply whenever you use OpenMap: the app, the website, the AI agent, Talk, and any OpenMap feature in another assistant.
These documents are part of these terms, so please read them too:
- the Acceptable Use Policy (what you must not do);
- the Community Guidelines (Moments, Adventures, reviews and groups);
- How the AI agent works (its limits and your approvals);
- the Business and Expert Terms, if you list, sell or receive enquiries on OpenMap; and
- the Partner Terms, if you are an OpenMap partner.
Our Privacy Notice and Cookie Notice explain how we use personal data. If these terms and another document disagree, the more specific document wins for its subject.
By creating an account, or by using OpenMap, you agree to these terms. If you don’t agree, please don’t use OpenMap.
2. Who can use OpenMap
- You must be 18 or over to create an account or use the agent.
- The details you give us must be true and kept up to date. You may have one personal account.
- Keep your sign-in secure. You’re responsible for what happens on your account, including what the agent does on your instructions, unless someone else used it without your permission and you weren’t careless.
- If you use OpenMap for a business, you confirm you’re allowed to act for it, and the Business and Expert Terms apply too.
3. What OpenMap is, and isn’t
OpenMap is a technology platform. It helps you find, compare, contact and book businesses, experts and other people, and it gives you an AI agent to do some of that work for you.
- We are not a party to your agreements with businesses. When you book, order, accept a quote or agree a job, your contract is directly with that business or expert. They are responsible for their service, its price, its quality, its safety and for keeping their promises to you.
- Businesses and experts are independent. They aren’t our employees, workers, agents or partners, and we don’t control how they do their work.
- We don’t vet or endorse them unless we say so expressly on the page, and then only to the extent we describe. A badge, rating, “Best fit” or Companies House record is information, not a guarantee. Reviews are other people’s opinions.
- We aren’t a letting agent, an employment agency, an insurer, a bank or a regulated adviser. Payments are processed by Stripe on behalf of the business.
You keep all your legal rights against a business. If something goes wrong with a service, contact the business first. We may help where we can, but we don’t have to settle disputes between you and a business.
4. The AI agent acts on your instructions
The agent is an AI system. It acts for you, on your instructions and within the approvals you set. It can search, browse websites in a private browser, contact businesses (and, where they have one, their own agents), make calls in the app, draft letters, and set reminders and schedules. How the AI agent works explains this in detail.
- You approve the important steps. The agent stops and asks you before it signs in to an account, pays, or sends something in your name for the first time. Check the details (the business, date, time, price, address and what’s being shared) before you approve. What you approve is your decision.
- Before it acts. Before your OpenMap agent books, buys or sends anything for you, it shows you what it will do and asks you to confirm. You’re responsible for checking the details (dates, names, prices, addresses) before confirming. If our agent does something you didn’t confirm, tell us within 30 days and we’ll put right what we reasonably can.
- The agent can be wrong. AI can misunderstand, miss things, or state things that aren’t true. Prices, availability, opening times and other facts can be out of date. Always check anything important before relying on it.
- It says it’s an AI. Messages the agent sends for you say so, for example “sent by Sam’s OpenMap agent”. You must not ask it to pretend to be you or a human.
- You authorise it to share what’s needed. When you ask it to contact a business, you allow it to share the details that task needs, as described in our Privacy Notice.
- Standing instructions and schedules keep running until you change or stop them.
5. No professional advice
Nothing on OpenMap, including anything the agent says, is legal, medical, financial, investment, tax, insurance or other professional advice. Don’t rely on it as such. For those, speak to a qualified professional.
OpenMap isn’t an emergency service. In an emergency, call 999. For urgent medical help, call NHS 111.
6. Bookings, orders and payments
- A quote, booking or order is an agreement between you and the business, on its terms (including its prices, cancellation rules and deposits). Read them before you agree.
- OpenMap never moves your money without you. Card details are entered by you and held by Stripe; we don’t see or store full card numbers.
- Changes, cancellations, refunds and exchanges are for the seller to give, under its terms and your legal rights. Contact the seller for these. If the seller doesn’t respond, tell us and we’ll pass your message on, but the decision is theirs.
- We don’t guarantee that a business will reply, quote, have availability, turn up or keep to its price.
- Travel. OpenMap doesn’t sell travel. Flights, hotels and holidays are booked with and paid to the travel company, which is responsible for them. If they sell you a package, it is their package and they give you any protection that comes with it. OpenMap isn’t an organiser or retailer of packages and doesn’t arrange linked travel.
7. Other sites and services
OpenMap may link to or work with other sites and services, such as delivery apps, booking sites, calendars, payment providers and other AI assistants. Their own terms and privacy notices apply to your use of them, and we aren’t responsible for them, their content or what they do.
When the agent browses a site for you, it does so as you would, on a site you chose or approved. You must have the right to use that site, and you’re responsible for keeping to its terms.
8. Your content
“Your content” means anything you add to OpenMap: messages, photos, reviews, Moments, Adventures, listings, polls and files. It stays yours, and you are responsible for it.
- You promise that you have the right to post it, that it’s accurate where it states facts, and that it follows the law, the Acceptable Use Policy and the Community Guidelines.
- You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, adapt (for example to resize or format), display and share your content, to run, improve and promote OpenMap, and to show it to the people you choose. For public Moments and Adventures, that includes anyone. The licence ends when you delete the content or your account, except for copies other people already have (such as messages in a group), backups for a short time, and where the law requires us to keep it.
- We may review, hide or remove content, and limit who sees it, if we think it breaks these terms or the law, or puts someone at risk. We don’t have to monitor content, and we aren’t responsible for other people’s content.
- To report content, use Report on it, or email support@openmap.ai. We act on reports of illegal content as the law requires, and we tell you if we remove yours, with how to ask us to look again.
9. Rules of use
You must follow the Acceptable Use Policy. In short: no illegal requests, no harassment or fraud, no misuse of the agent or other people’s accounts, and no scraping, copying or overloading OpenMap.
10. Rentals, Moments, Adventures and groups
- Rentals. OpenMap is an advertising platform for rentals, not a letting agent. We don’t check landlords or properties, take rent or deposits, or write tenancies. Never pay before you’ve viewed a property and checked the landlord.
- Moments and Adventures are made by other people. We don’t check that places are safe, open, accessible or that you’re allowed to be there. You take part at your own risk, follow local laws and signs, and take care, especially outdoors and near traffic or water.
- Meeting people. When you meet someone you found on OpenMap, meet in a public place first and tell someone where you’re going. See Safety.
- Groups and polls are run by their members. The person organising a plan is responsible for it.
This doesn’t limit our responsibility for death or personal injury caused by our own negligence.
11. Plans, credits, charges and cancelling
Using OpenMap as a person is free within the allowances on the pricing page. If we offer you a paid plan, we’ll show the price, what it includes and how it renews before you agree, and you can cancel it at any time from Settings; it then ends at the end of the period you’ve paid for.
If you’re a consumer, you can usually cancel within 14 days of buying. When you buy credits we ask you to tick a box asking us to add them straight away and confirming that you lose that 14-day right to cancel once they’re added. A plan is different: you can still cancel it in the first 14 days of first subscribing (and in the first 14 days of each annual renewal), and we refund the unused part minus the credits and use you’ve already had (see section 11A). This doesn’t affect your other legal rights.
Credits. Plus and Pro come with credits each month (1 credit is 1p). Your monthly credits are used first and don’t roll over: they end with the period. You can also buy extra credits (a top-up of £10, £25 or £50). Purchased credits are used after your monthly ones, oldest first, and they last for 12 months from the day you buy them. If you cancel your plan, you keep the purchased credits you haven’t used until they expire. Credits are for using OpenMap only: they have no cash value, can’t be withdrawn or sent to anyone, and can’t be used to pay a business. Refunds are covered in section 11A.
If you run out. We never charge you automatically for more unless you have switched on automatic top-up (below). Otherwise your agent finishes the task it has already started and then asks you before it goes any further. We tell you when you have used 80% and 95% of your monthly credits.
Renewal reminders. We email you before each annual renewal, and every 6 months while a monthly plan continues, with the price and how to cancel.
Cancelling and refunds. You can cancel a plan at any time from Settings. It then ends at the end of the period you’ve paid for, and the monthly credits that come with it end then too. After the first 14 days of first subscribing (or of an annual renewal), the plan fee for a period that has started isn’t refunded (see section 11A), apart from anything the law requires. If you think we’ve charged you wrongly, email support@openmap.ai and we’ll look into it. This doesn’t affect your legal rights.
Automatic top-up (your consent). It is off unless you switch it on in Settings, under Plan and usage. When you switch it on, you confirm once, and we show you the amount and the limit first. By switching it on you agree that we may charge the card you have saved with us for the top-up amount you chose (£10, £25 or £50) when you have used 90% of your monthly credits. It happens once each time your use crosses 90%; it can happen again only after your use has fallen back below 90%, for example in a new month or after a top-up. You also choose a monthly limit for automatic top-ups (£20, £50, £100 or an amount you choose), and we never charge beyond it. Each time we top up, we email you and tell you in the app how much was added and how much of your limit is used. If a payment fails, automatic top-up switches itself off and we tell you; we don’t keep retrying. To turn it off, go to Settings, then Plan and usage, then Automatic top-up, and switch it off. It stops straight away for any top-up that hasn’t happened yet. If you take two or more top-ups in a month, we may suggest a bigger plan, but we never change your plan for you.
11A. Refunds
Credits. Credits are added to your account as soon as you pay, and once added they can’t be refunded, transferred or exchanged for cash. Unused credit expires 12 months after purchase.
Plans. If you cancel within 14 days of first subscribing, we refund the unused part of that first period minus the credits and use you’ve already had. After that, cancelling stops the next payment and the current period isn’t refunded. On an annual plan the same 14 days apply at the start of each annual renewal. This doesn’t affect your statutory rights, for example if something we supply is faulty.
Business terms. Business plans, call minutes and network booking fees are non-refundable.
12. The service and changes to it
We work hard to keep OpenMap running and accurate, but we provide it as it is and as it is available. We don’t promise that it will always be available, free of errors, or that the agent will complete every task. We may change, add or remove features. If a change means you lose something you paid for, we’ll tell you and give you a fair refund.
Features marked as a preview or “Coming next” may change or end, and may not be available to everyone. None of this affects your legal rights as a consumer (see section 13).
13. Our responsibility for loss
What we are responsible for. If we break these terms or fail to use reasonable care and skill, we’re responsible for loss you suffer that is a foreseeable result. Loss is foreseeable if it’s obvious it will happen, or if we both knew it might when you started using OpenMap. If digital content we supply damages your device or other digital content, and that’s because we didn’t use reasonable care and skill, we’ll repair the damage or pay you fair compensation.
What we aren’t responsible for. As far as the law allows, we aren’t responsible for:
- loss that isn’t foreseeable;
- the acts, omissions, services, products, prices or content of businesses, experts, other users or other sites, including any contract you make with them;
- loss caused by acting on agent output, or approving a step, without checking it as we ask you to;
- events outside our reasonable control (see section 19); or
- business losses (such as lost profit or business opportunity), because OpenMap for people is for your private use. The Business and Expert Terms cover business use.
Our limit. Our total liability to you for any claim about our own service is limited to the greater of £100 and the amount you paid us in the 12 months before the claim. We aren’t liable for losses that weren’t foreseeable, for business losses, or for anything the seller does or fails to do.
What we never limit. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn’t allow us to limit. This includes fraud or fraudulent misrepresentation, and your legal rights as a consumer, for example to services provided with reasonable care and skill and as described. The limit above doesn’t apply to these.
14. If you break these terms
You’re responsible for loss that we or others suffer as a foreseeable result of you breaking these terms, using OpenMap unlawfully or fraudulently, or posting content you didn’t have the right to post. If you use OpenMap for a business, the indemnity in the Business and Expert Terms applies.
15. Suspending or closing accounts
You can close your account at any time in Settings. We may suspend or close your account, or limit features, if you seriously or repeatedly break these terms, if we must for legal reasons, or to protect people, OpenMap or others from harm or fraud. Where it’s fair and safe to, we’ll tell you first and give you the reason. If we close an account for any other reason, we’ll give you at least 30 days’ notice and refund any part of a paid plan you haven’t used.
Sections that by their nature should continue (including 8, 13, 14, 17 and 18) still apply after your account is closed.
16. Changes to these terms
We may update these terms, for example when the law or OpenMap changes. We’ll give you at least 30 days’ notice of a change that matters, by email or in the app, unless we must change sooner for legal or safety reasons. If you don’t agree, you can close your account before the change takes effect. If you keep using OpenMap after that, the new terms apply. We may ask you to agree again to an important change.
17. Complaints
If you’re unhappy with OpenMap, email support@openmap.ai with what happened. We aim to reply within 14 days. For a problem with a business’s service, contact the business first; their terms and your legal rights against them apply. If we can’t resolve your complaint, you can get free advice from Citizens Advice, and you can go to court. We don’t currently use an alternative dispute resolution provider.
18. Law and courts
These terms are governed by the law of England and Wales, and the courts of England and Wales can hear disputes. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts, and you keep any protections your local law gives you as a consumer.
19. Other important terms
- Events outside our control. We aren’t responsible for delay or failure caused by events outside our reasonable control, such as outages at our providers, internet failures, strikes, fire, flood, pandemic or government action. We’ll tell you and try to limit the effect.
- Transfer. We may transfer this agreement to another organisation, and we’ll tell you if we do; your rights won’t be reduced. You may only transfer it with our written agreement.
- Nobody else has rights under these terms except you and us.
- If a court finds part of these terms can’t be enforced, the rest still applies.
- If we don’t enforce a term straight away, we can still enforce it later.
19A. Places from Google Maps
Some places we show you come from Google Maps Platform. By using them you also agree to Google Maps Platform Terms of Service and to Google’s Privacy Policy.
- Details from Google (a name, address, phone number or website) are shown to you for that visit only. We don’t keep them, so after you reload a chat you see the place’s name as you wrote it and a link to open it in Google Maps.
- We never show Google’s place details on OpenMap’s own map, and we never read them out loud in Talk.
- Where we show places from Google, we say so and we show the Google Maps mark with the details.
